Okay, before we get to the data, I want to discuss the ongoing response to last month's Supreme Court ruling that lawsuits against freight brokers for negligent selection of carriers are not preempted by federal law. Now, if this is the first you're hearing about this court ruling, I gather you've been

on vacation for the past month and probably need to catch up on some things. In any event, as I and of course many others have noted, the significance of the court's ruling is not just in finding that brokers have potential liability. That was actually largely the status quo in much of the country anyway before the ruling. It's more that the Supreme Court has confirmed that exposure nationwide, but there is no more clarity in what constitutes negligence today than there was before

the court's decision. Now, given that gap between clear liability on the one hand and lack of a safe harbor on the other, the Transportation Intermediaries Association last week petitioned the Federal Motor Carrier Safety Administration for a rulemaking to establish a motor carrier safety selection standard and to publish a list of high-risk motor carriers. The list TIA seeks would identify carriers that have exceeded

intervention thresholds in three or more basics within the safety measurement system or in any one of the most critical categories. Those include unsafe driving, crash indicator, hours of service compliance, or vehicle maintenance. Regarding the list of high-risk carriers, I don't think I'm going out on a limb here by declaring that publication of such a list would essentially be the same as an obituary for operations on that list. After all, now that we know for sure that brokers can be sued for negligent

selection nationwide, it would, in my opinion, be extraordinarily foolish for a broker or a shipper to retain a carrier that was listed publicly as high-risk.
